Privacy Policy — Monaco Lux Yachts
Last updated:
This page explains how Monaco Lux Yachts handles the personal data of visitors to this website and of anyone who enquires about, or books, a yacht or boat charter with us. It applies whether you reach us through the enquiry form, by email, phone or WhatsApp, or simply by browsing the site.
It is written for charter guests, prospective guests, and anyone else whose data passes through our booking system. Where you are visiting us from within the European Union, the EU General Data Protection Regulation also applies alongside Monaco law.
Who is responsible for your data?
The controller is Monaco Lux Yachts, the brand under which this website and our yacht charter service are operated from Monaco. For any question about this policy, or to exercise your rights, write to [email protected]. We answer every privacy request ourselves; we do not outsource this to a third party.
What data do we collect, and where does it come from?
When you send an enquiry, we collect your name, email address, phone number if you give it, the yacht you are interested in if you chose one, your charter start and end dates, the number of guests, and whatever you write in the message field. The form also records the page you were on and the site that referred you, so we understand which enquiries come from which page.
If you contact us by email, phone or WhatsApp instead, we collect whatever you tell us directly in that conversation. When you tap a WhatsApp button on the site, we record the click itself — the page URL, the referrer, the site language and the prefilled message text — in our booking system before WhatsApp opens; the conversation that follows then runs entirely inside WhatsApp.
Our server also keeps standard technical logs of each visit (IP address, time, page requested, browser), and our own visit-measurement script records things like pages viewed, time on page, referring site, campaign parameters in the link, device type, browser, operating system, screen size, browser language and the country derived from your IP address. We do not store the IP address itself for this purpose, and we do not use any third-party analytics, advertising or social-media trackers.
Why do we use your data, and on what basis?
We use enquiry and contact data to answer your request, prepare a written quote, and discuss or confirm a charter with you. This rests on the steps needed before a contract and, once you book, on the performance of that contract.
Server logs and visit-measurement data are used to keep the site secure, understand how it is used, and see which channel brought you to us; this rests on our legitimate interest in running a secure, well-functioning website, balanced against your right to privacy.
Once a charter is confirmed, certain data must be kept and used to meet our accounting and tax obligations, and guest names are passed on where port or maritime authorities require a crew list for the vessel — this rests on a legal obligation and is explained further below.
Who receives your data?
Enquiry and booking data is seen by our own team, through our internal booking and messaging tools, so we can reply quickly and manage your charter.
For a confirmed charter, we share the guest names, and the dates and details of the trip, with the captain or driver who will actually run the charter, because they need this to prepare the vessel, welcome you properly, and, where required, to complete the crew list that port authorities in Monaco and along the Riviera ask us to hold for safety and immigration purposes.
The website itself is served by a hosting provider that stores the pages and the technical logs described above. Two outside services are used purely to make the site work: Google Fonts, which loads the typefaces used on the page, and the jsDelivr content delivery network, which loads the library used to validate phone numbers in the enquiry form. Neither sets cookies for us. If you start a conversation with us on WhatsApp, that exchange is handled by WhatsApp and its parent company, Meta, under their own privacy policy, which applies to that part of the conversation.
We never sell your personal data, and we never use it to make automated decisions about you.
Does your data leave Monaco?
Loading Google Fonts means your device sends its IP address to Google's servers when a page loads; this is a standard, automatic part of loading a web font and happens outside Monaco. If you choose to write to us on WhatsApp, that conversation is also processed by Meta outside Monaco, under WhatsApp's own terms. Where this involves data leaving Monaco, it is limited to what is strictly needed to display the site or carry your message, and does not involve us separately transferring your file to anyone else abroad.
How long do we keep your data?
If your enquiry does not turn into a booking, we delete it after twelve months. If it does lead to a confirmed charter, we keep the booking record for as long as tax and accounting rules require us to.
The local-storage entry that remembers you closed the cookie notice, and the one that remembers which yacht you clicked on so the enquiry form can be prefilled, contain no contact details; the latter is deleted as soon as you close the tab or send the form. The identifiers used for visit measurement expire thirty days after your last visit and can be cleared from your browser at any time. Security logs on our server are kept for a short period and then removed.
How do we protect your data?
Enquiry and booking data is held in our own booking system with access limited to the people who need it to prepare your quote or run your charter. The website does not ask for payment details, since bookings are never paid online — every charter is confirmed in writing after you and our team agree a quote by email, phone or WhatsApp. Server logs are used only for security purposes and kept no longer than needed for that.
What are your rights, and how do you use them?
Under Monaco Law No. 1.565 of 3 December 2024 on personal data protection, and under the GDPR if you are visiting from the European Union, you can ask us to:
- confirm whether we hold data about you, and get a copy of it
- correct data that is inaccurate or incomplete
- delete data we no longer need
- restrict or object to certain uses of your data
- receive a copy of the data you gave us in a portable format
To use any of these rights, write to [email protected]. We may ask you to confirm your identity before acting on the request, and we reply within one month.
If you believe we have not handled your data correctly, you can also lodge a complaint with the Autorité de Protection des Données Personnelles (APDP) in Monaco.
Children, marketing, and changes to this policy
This site and our charter service are addressed to adults arranging their own travel, not to children. We do not send marketing emails unless you specifically ask us to.
We may update this policy if the way the site or our service works changes. The version published here is always the one that applies, and we encourage you to check it before sending us an enquiry.
